Liability Waiver

LIABILITY WAIVER & ASSUMPTION OF RISK

By signing this agreement, I acknowledge and agree to the following terms and conditions relating to participation at Selwyn Combat Sports Centre (“the Gym”).

1. Acknowledgement of Risk

I understand that participation in martial arts, combat sports, fitness training, strength and conditioning, recovery services, and related activities involves inherent risks of injury, illness, permanent disability, or death.

These activities may include, but are not limited to:

  • Brazilian Jiu Jitsu (BJJ)
  • Mixed Martial Arts (MMA)
  • Wrestling
  • Judo
  • Kickboxing
  • Boxing
  • Strength and Conditioning
  • Weightlifting
  • Sparring and live drilling
  • Throws, takedowns, submissions, chokes, and joint locks
  • Use of gym equipment
  • Sauna, ice bath, massage, physiotherapy, and recovery services

I understand that injuries may occur from physical contact, accidental impact, equipment failure, overexertion, negligence of others, or unsafe conditions.

I voluntarily choose to participate with full knowledge and acceptance of these risks.

2. Medical & Physical Condition

I confirm that:

  • I am physically and medically fit to participate in training activities.
  • I do not have any medical condition that would make participation unsafe.
  • I will inform coaches or staff of any injuries, illnesses, medical conditions, or physical limitations prior to participation.
  • I understand it is my responsibility to seek medical advice if I am unsure of my fitness to train.

I acknowledge that the Gym does not provide medical insurance for members or guests.

3. Assumption of Responsibility

I voluntarily assume full responsibility for any risks, injuries, damages, or losses that may occur as a result of participation at the Gym, including injuries caused by:

  • Physical contact with instructors or other members
  • Training techniques or sparring
  • Use of equipment or facilities
  • Negligence of other participants
  • My own actions or failure to follow instructions

4. Release of Liability

To the fullest extent permitted by New Zealand law, I release and discharge Selwyn Combat Sports Centre, its owners, directors, coaches, instructors, employees, contractors, volunteers, agents, and members from any and all liability, claims, demands, actions, or causes of action arising out of or related to:

  • Personal injury
  • Illness
  • Death
  • Property damage or loss
  • Economic loss

whether caused by negligence or otherwise, arising from participation in activities at the Gym or use of its facilities.

5. Property & Personal Belongings

I understand that Selwyn Combat Sports Centre is not responsible for lost, stolen, or damaged personal property brought onto the premises.

6. Conduct & Safety

I agree to:

  • Follow all instructions given by coaches and staff
  • Train safely and respectfully
  • Maintain proper hygiene standards
  • Use equipment responsibly
  • Avoid behaviour that may endanger myself or others

I understand that the Gym reserves the right to suspend or terminate membership or access for unsafe, abusive, inappropriate, or disruptive behaviour.

7. Photography & Media Release

I acknowledge that photographs and videos may occasionally be taken during classes, competitions, seminars, or events.

Unless I notify the Gym in writing, I consent to the use of my image or likeness for promotional, marketing, and social media purposes by Selwyn Combat Sports Centre.

8. Parents & Guardians (For Members Under 18)

As the parent or legal guardian of the participant, I:

  • Consent to their participation in training and activities
  • Accept the risks outlined in this waiver on their behalf
  • Agree to all terms and conditions contained within this agreement

9. Agreement & Electronic Acceptance

I acknowledge that:

  • I have read and understood this Liability Waiver and Assumption of Risk Agreement in full
  • I understand I am giving up certain legal rights, including the right to make claims against Selwyn Combat Sports Centre
  • I voluntarily agree to these terms

By signing this document or digitally accepting this waiver, I confirm that I agree to be legally bound by its contents.
